NOTICE OF ASSESSMENT LIEN
FORECLOSURE SALE
NOTICE IS HEREBY GIVEN THAT default has occurred in the terms, conditions, and provisions of (i) the Amended and Restated Declaration of Hi Crest Square, Common Interest Community No. 2085, Hennepin County, Minnesota, recorded in the office of the Registrar of Titles in and for Hennepin County, Minnesota (the "Registrar"), on February 27, 2018, as Document No. T05514248 (the "Amended Declaration"), (ii) the Amended and Restated Bylaws (the "Bylaws") of Hi Crest Square Homeowners Association, Inc. (the "Association" or "Lienor"), a Minnesota nonprofit corporation, and (iii) Minnesota Statutes Chapter 515B ("Chapter 515B"). Said default creates a lien in favor of the Association and against the real property described herein. Said lien includes unpaid amounts assessed to and levied against said real property by the Association on and after said date of recording of the Amended Declaration, and, pursuant that certain Declaration of Covenants, Conditions and Restrictions of Hi Crest Square recorded in the Registrar's office as Document No. 1516695 (the "Original Declaration") (which has been amended and restated, and superseded in its entirety, by the Amended Declaration), prior to said date of recording of the Amended Declaration.
LEGAL DESCRIPTION OF THE REAL PROPERTY: Lot 5, Block 2, Hi Crest Square Estates, Hennepin County, Minnesota,
which is registered land with Certificate of Title No. 715487.
ADDRESS OF THE REAL PROPERTY: 1316 68th Lane North, Brooklyn Center, Minnesota 55430.
TAX PARCEL IDENTIFICATION NUMBER OF THE REAL PROPERTY: 36-119-21-22-0059.
LIENEE: Valerie McKissack (who may also be known as Valerie Blount) (the "Lienee"), who is the owner of said real property.
LIENOR: Hi Crest Square Homeowners Association, Inc.
AMOUNT DUE AND CLAIMED TO BE DUE TO THE ASSOCIATION ON THE LIEN DESCRIBED HEREIN, ON THE DATE OF THIS NOTICE:
$11,009.77.
Said amount due and claimed to be due includes unpaid annual assessment installments (and unpaid portions thereof), unpaid interest, unpaid late fees, and unpaid costs of collection and foreclosure and unpaid attorney's fees incurred by the Association, all as assessed to and levied against said real property by the Association pursuant to the Amended Declaration, Chapter 515B, and (as to those unpaid amounts that became due and payable to the Association prior to the date of recording in the Registrar's office of the Amended Declaration) the Original Declaration. All of said unpaid amounts are collectively referred to hereinafter as the "Debt." Pursuant to Chapter 515B, the Amended Declaration, and the Original Declaration, taken together, the Debt creates a lien in favor of the Association against said real property.
Pursuant to the Amended Declaration, the Bylaws, Chapter 515B, and/or the Original Declaration, taken together, the Lienee is financially obligated to pay the Debt to the Association, as well as all unpaid assessments and/or installments thereof (as may be accelerated by the Association), unpaid interest, unpaid late fees, and unpaid costs of collection and foreclosure and unpaid attorney's fees incurred by the Association in collection of the Debt and in foreclosure of the Association's lien against said real property, and all other unpaid amounts, which the Association assesses to and levies against said real property and which are due and payable by the Lienee to the Association after the date of this Notice, which additional unpaid amounts are also part (or will be part) of said lien and are subject to this foreclosure.
DATE AND PLACE OF RECORDING OF LIEN: The Lien Statement in favor of the Association, and evidencing said lien, is dated December 7, 2018, and was recorded in the Registrar's office on December 10, 2018, as Document No. T05580417, which Lien Statement was amended and restated by that certain Amended and Restated Lien Statement in favor of the Association, dated March 29, 2019, and was recorded in said office on April 1, 2019, as Document No. T05603051.
All pre foreclosure requirements have been complied with by the Association. There are no actions or proceedings instituted at law by the Association to recover the Debt or any part thereof. The Lienee has not been released from the Lienee's personal obligation to pay the Debt.
Pursuant to the power of sale granted to the Association pursuant to Chapter 515B and the Amended Declaration, said lien will be foreclosed by the sale of said real property by the Sheriff of Hennepin County, Minnesota, at the office of the Sheriff of Hennepin County, Minnesota, 350 South 5th Street, Room 30, Minneapolis, Minnesota 55415, on June 11 2019, at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for all unpaid annual assessment installments (and unpaid portions thereof) (as may be accelerated by the Association), unpaid interest, unpaid late fees, unpaid costs of collection and foreclosure, unpaid attorney's fees, and all other unpaid amounts, assessed to and levied against said real property by the Association through the date of said sale.
TIME ALLOWED BY LAW TO REDEEM: The Lienee, the Lienee's personal representatives or assigns, has the right to redeem said real property within six months after said sale.
The Lienee must vacate said real property on or before 11:59 p.m. on December 11, 2019 (or the next business day if December 11, 2019, falls on a weekend or a legal holiday), if said lien is not reinstated under Minnesota Statutes Section 580.30, or if said real property is not redeemed under Minnesota Statutes Section 580.23, or if said redemption period is not reduced under Minnesota law.
REDEMPTION NOTICE
THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE LIENEE, OR THE LIENEE'S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE LIENED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
