Association Name: Brittany Village Homeowners' Association (the "Association")
1. Default has occurred in the conditions of the Common Interest Community Number 1074, (Planned Community), Brittany Village Declaration (the "Declaration") by Kham Phalavong, as fee owner(s) of the below-described property subject to said Declaration.
2. Pursuant to the Declaration, filed in the Office of the County Recorder for Scott County, Minnesota, on August 31, 1999, as Document No. A455688, and all amendments thereto, and the Statement of Assessment Lien, filed in the Office of the County Recorder for Scott County, Minnesota on November 18, 2025 as Document No. A1214910, and/or Minnesota Statutes Chapters 515B, a lien exists for unpaid assessments and fees.
3. No action or proceeding has been instituted at law to recover the debt secured by the lien or any part thereof, or if an action has been instituted it has been dismissed or discharged prior to the commencement of these proceedings.
4. The Association, holder of the lien, has complied with all conditions precedent to foreclosure of said lien, and all notice and other requirements of applicable statutes.
