YOU ARE NOTIFIED THAT, Association Name: Capitol Heights City Homes Owners' Association (the "Association") 1. Default has occurred in the conditions of the Common Interest Community No. 446, Condominium, Capitol Heights City Homes Declaration (the "Declaration") by Juan M. Garibay Rodriguez and Luz Jeanett Quintana, as fee owner(s) of the below-described property subject to said Declaration. 2. Pursuant to the Declaration, filed in the Office of the County Recorder for Ramsey County, Minnesota, on June 27, 2002, as Document No. 3512169, and all amendments thereto, and the Statement of Assessment Lien, filed in the Office of the County Recorder for Ramsey County, Minnesota on March 27, 2026 as Document No. A05100501, and/or Minnesota Statutes Chapters 515B, a lien exists for unpaid assessments and fees. 3. No action or proceeding has been instituted at law to recover the debt secured by the lien or any part thereof, or if an action has been instituted it has been dismissed or discharged prior to the commencement of these proceedings. 4. Pursuant to the provisions of the Declaration, the lien will be foreclosed, and the property will be sold by the Sheriff of Ramsey County, State of Minnesota, as follows: Date and time of sale: June 25, 2026 at 10:00 a.m. Place of sale: Ramsey County Sheriff's Office Civil Division, 360 Wabasha Street North, Suite 111, St. Paul, MN 55102 to pay the debt then secured by said lien, including any additional assessments and late fees that may become due through the date of sale, along with the costs, attorney's fees and disbursements allowed by law. 11.
