THIS COMMUNICATION IS FROM A DEBT COLLECTOR. THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE
NOTICE IS HEREBY GIVEN that default has been made in the terms and conditions of the Declaration of Pleasant Creek Homeowners' Association, Inc., (hereinafter the "Declaration") recorded in the office of the County Recorder of Wright County, Minnesota on September 1, 2004, as Document No. A925433, which covers the following property:
Legal Description: Lot 1, Block 7, Pleasant Creek Farms 2nd Addition, CIC No. 72
Property Address: 11123 76th Lane NE, Otsego, Minnesota 55301
PID: 118-187-007010
THAT pursuant to said Declaration, there is claimed to be due and owing as of June 2, 2025, Kevin Price, title holder, to Pleasant Creek Homeowners' Association, Inc., a Minnesota non-profit corporation, the amount of $18,873.92, for assessments, late fees and collection costs, plus additional assessments and other amounts that may have accrued since the date of this notice, including the costs of collection and foreclosure;
THAT prior to the commencement of this foreclosure proceeding, Lienor complied with all notice requirements as required by statute; that no action or proceeding has been instituted at law or otherwise to recover the debt secured by said lien, or any part thereof;
THAT the owner has not been released from his financial obligation to pay said amount;
THAT pursuant to Minn. Stat. § 515B.3-116 and/or the Declaration, said debt creates a lien upon said premises in favor of Pleasant Creek Homeowners' Association, Inc., as evidenced by a lien statement dated October 29, 2024, and recorded on November 21, 2024, in the office of the Wright County Recorder as Document No. A1565525;
THAT pursuant to the power of sale granted by the owners in taking title to the premises subject to said Declaration, said lien will be foreclosed by the sale of said property by the sheriff of said County at the Main Office of the Wright County Sheriff, Civil Division, 3800 Braddock Avenue NE, City of Buffalo, Wright County, Minnesota, on August 6, 2025, at 10 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorney=s fees as allowed by law. The time allowed by law for redemption by the unit owners, their personal representatives or assigns is six (6) months from the date of said sale.
DATE TO VACATE PROPERTY: The date on or before which the owner must vacate the property if the account is not brought current or the property redeemed under Minn. Stat. § 580.23 is February 6, 2026. NOTICE IS HEREBY GIVEN, that pursuant to that certain Findings of Fact, Conclusions of Law, Judgment; Order for Judgment and Decree of Foreclosure dated October 23, 2024, and entered in the above entitled action on October 23, 2024, by the District Court of Anoka County, Minnesota, Tenth Judicial District (the "Judgment"), a certified copy of which has been delivered to me directing the sale of the premises hereinafter described, to satisfy the amount found and adjudged due and owing to Plaintiff Village Bank (the "Bank") in the above-entitled action from Defendants Capra's Outdoors Inc., McDahl Holdings LLC, Brian McNallan and Karla-Jean McNallan (collectively, the "Defendants"), as prescribed in the Judgment, the undersigned Sheriff of Anoka County will sell at public auction, to the highest bidder, for cash, on Tuesday, August 12, 2025 at 10:00 a.m., at the Anoka County Sheriff's Office, 13301 Hanson Boulevard NW, Andover, Minnesota, 55303, the premises and real estate, lying and being in the County of Anoka, State of Minnesota, described in said Judgment, to wit: Lot 5, Block 7, Sherbrook, Anoka County, Minnesota (the "Property") and together with (i) all buildings and improvements now or hereafter located at the Property, (ii) all of the estate, right, title, claim or demand of any nature whatsoever of the Defendants either in law or in equity, in possession or expectancy, in and to the Property or any part thereof; (iii) all easements, rights-of-way, gores of land, streets, ways, alleys, passages, sewer rights, water, water courses, water rights and powers, and all estates, rights, titles, interests, privileges, liberties, tenements, hereditaments, and appurtenances of any nature whatsoever, in any way belonging, relating or pertaining to the Property (including, without limitation, any and all development rights, air rights or similar or comparable rights of any nature whatsoever now or hereafter appurtenant to the Property or now or hereafter transferred to the Property) and all land lying in the bed of any street, road or avenue, opened or proposed, in front of or adjoining the Property to the center line thereof; (iv) all machinery, apparatus, equipment, fittings, fixtures and other property of every kind and nature whatsoever owned by the Defendants, or in which the Defendants has or shall have an interest, now or hereafter located upon the Property, or appurtenances thereto, or usable in connection with the present or future operation and occupancy of the Property and all building equipment, materials and supplies of any nature whatsoever owned by the Defendants, or in which the Defendants have or sha1l have an interest, now or hereafter located upon the Property; (v) all awards or payments, including interest thereon, and the right to receive the same, which may be made with respect to the Property, whether from the exercise of the right of eminent domain (including any transfer made in lieu of the exercise of said right), or for any other injury to or decrease in the value of the Property; (vi) all leases and other agreements affecting the use or occupancy of the Property now or hereafter entered into and the right to receive and apply the rents, issues and profits of the Property; (vii) all proceeds of and any unearned premiums on any insurance policies covering the Property, including, without limitation, the right to receive and apply the proceeds of any insurance, judgments, or settlements made in lieu thereof, for damage to the Property; (viii) the right, in the name and on behalf of the Defendants, to appear in and defend any action or proceeding brought with respect to the Property and to commence any action or proceeding to protect the interest of the Bank in the Property; and (ix) all proceeds of each of the foregoing.
