NOTICE OF ASSESSMENT LIEN FORECLOSURE SALE
NOTICE IS HEREBY GIVEN THAT default has occurred in the conditions of Minnesota Statutes Chapter 515B ("Chapter 515B") and in the conditions of the Declaration of 1900 Fourth Avenue Condominium, Common Interest Community No. 1331, Hennepin County, Minnesota, dated November 15, 2004, and recorded in the office of the County Recorder in and for Hennepin County, Minnesota (the "Recorder"), on February 18, 2005, as Document No. 8530189 ("Declaration"). Said default creates a lien in favor of 1900 Fourth Avenue Condominium Association (the "Association"), a Minnesota nonprofit corporation, and against the real property described herein. That lien is established by Chapter 515B.
LEGAL DESCRIPTION OF THE REAL PROPERTY:
Unit 1A, 1900 Fourth Avenue Condominium, Common Interest Community No. 1331, Hennepin County, Minnesota.
ADDRESS AND TAX PARCEL IDENTIFICATION NUMBER OF SAID REAL PROPERTY:
Address: 1902 4th Avenue South, Unit 1A, Minneapolis, Minnesota 55404.
Tax Parcel Identification Number: 27-029-24-44-0277.
LIENEE: Patrick Thomas Lyman (the "Lienee"), who is the record owner of said real property.
LIENOR: 1900 Fourth Avenue Condominium Association, which is a Minnesota nonprofit corporation.
LIEN STATEMENT: The Lien Statement in favor of the Association, and evidencing said lien in favor of the Association, is dated April 4, 2025, and was recorded in the Recorder's office on April 17, 2025, as Document No. 11363037. Said Lien Statement shows a lien amount of $20,362.72 as of the last unpaid amount itemized in that Lien Statement.
AMOUNT DUE AND CLAIMED TO BE DUE TO THE ASSOCIATION ON THE LIEN DESCRIBED HEREIN, ON THE DATE OF THIS NOTICE:
$24,896.11.
Said amount due and claimed to be due to the Association on the lien described herein (on the date of this Notice) includes unpaid annual assessment installments, unpaid late fees, unpaid special assessment installments, unpaid repair charges (assessments), unpaid attorney's fees incurred by the Association with regard to said real property and the Lienee, and unpaid costs of collection incurred by the Association with regard to said real property and the Lienee, all as (or deemed to be) assessed to and levied against said real property by the Association, and/or charged by the Association to the Lienee, all pursuant to, taken together, the Declaration and Chapter 515B. All of said unpaid amounts are collectively referred to hereinafter as the "Debt." Pursuant to Chapter 515B, the Debt creates a lien in favor of the Association against said real property.
Pursuant to Chapter 515B, the Lienee is financially obligated to pay the Debt to the Association, as well as to pay to the Association all unpaid assessments and/or installments thereof (as may be accelerated by the Association), unpaid late fees, unpaid attorney's fees incurred by the Association with regard to said real property and/or the Lienee, unpaid costs of collection and foreclosure incurred by the Association with regard to said real property and/or the Lienee, and all other unpaid amounts, charged by the Association to the Lienee and which are and will be due and payable to the Association after the date of this Notice, with all of said unpaid amounts to be, in addition to the Debt, part of said lien in favor of the Association and subject to this foreclosure (all to the extent all or any of such unpaid amounts are, or will be, part of the Association's lien against said real property).
All pre foreclosure requirements have been complied with by the Association. There are no actions or proceedings instituted at law by the Association to recover the Debt or any part thereof. The Lienee has not been released from the Lienee's financial obligation on said lien.
Pursuant to the power of sale granted to the Association pursuant to Chapter 515B, said lien in favor of the Association will be foreclosed by the sale of said real property by the Sheriff of Hennepin County, Minnesota, at the office of the Sheriff of Hennepin County, Minnesota, 350 South 5th Street, Room 190, Minneapolis, Minnesota 55415, on August 25, 2025, at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for all unpaid annual assessment installments, unpaid late fees, unpaid special assessment installments, unpaid repair charges (assessments), unpaid attorney's fees incurred by the Association with regard to said real property and the Lienee, and unpaid costs of collection incurred by the Association with regard to said real property and the Lienee, and all other unpaid amounts, assessed to and levied (and deemed assessed to and levied) against said real property by the Association, and/or which are deemed part of said lien, and which are due and payable to the Association, through the date of said sale.
TIME ALLOWED BY LAW TO REDEEM: The Lienee, the Lienee's personal representatives or assigns, has the right to redeem said real property within six months after said sale.
The time that the Lienee must vacate said real property is 11:59 p.m. on February 25, 2026 (or the next business day if February 25, 2026, falls on a legal holiday), if said lien is not reinstated under Minnesota Statutes Section 580.30, or if said real property is not redeemed under Minnesota Statutes Section 580.23, or if said redemption period is not reduced under Minnesota law.
There is no "transaction agent," "residential mortgage servicer," "lender," "broker," or "residential mortgage originator," as those terms are defined in Minnesota Statutes Section 58.02, involved with said lien or in this matter.
REDEMPTION NOTICE
THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE LIENEE, THE LIENEE'S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE LIENED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
